POLICY

RENTAL POLICIES, TERMS AND CONDITIONS

RENTAL AGREEMENT

CLIENT agrees to all the clauses stated in this rental agreement by paying the rental deposit.

CLIENT hereby engages and Tahoe Event Rentals hereby agrees to furnish all items herein (REFER TO CLIENT’S INVOICE), cleaned, complete and in good working conditions with no missing or broken parts, as described upon the terms and conditions set forth herein. CLIENT agrees all items are in good operating condition and free of defects. CLIENT also agrees they have received, reviewed, and understand all training and instructions for all rented items. CLIENT agrees to return all items in the same working condition without breakage or damage. CLIENT agrees to be responsible for any missing or damaged items to Tahoe Event Rentals equipment or properties beginning from time of pick up or after delivery until items are returned to Tahoe Event Rentals. CLIENT expressly assumes and is liable for full replacement costs associated with the damaged or missing items including all shipping or handling fees. CLIENT shall not loan, transfer, license, sublease, surrender or assign any item(s) or this Contract. CLIENT is responsible for all terms of this contract. CLIENT shall agree to use all rented items safely, within its rated capacity, only for the intended purpose of the item, and in full compliance with this contract. Tahoe Event Rentals reserves the right to substitute items, when necessary, with items of a similar nature, equal value and comparable style at no additional charge or credit to the client.

DEPOSIT

A 50% deposit payment is required to confirm orders. All orders are refundable within 14 days of deposit payment. After 14 days all orders are non-refundable. Full payment must be received 30 days prior to the scheduled delivery date, or the rental order will be cancelled. All orders are based on a 24-hour rental period unless otherwise stated by Tahoe Event Rentals. Multiple-day rental is available for an additional discounted fee.

UPON RECEIPT OF RENTAL ITEMS

CLIENT agrees to be present or have a designated representative present at time of delivery. CLIENT is fully responsible for any missing items or any unreasonable damage to Tahoe Event Rentals equipment. If any unreasonable damage is caused, CLIENT expressly assumes and is liable for full replacement costs associated with the damaged or missing items. CLIENT expressly assumes the responsibility of informing all person(s) who use the above specified rental equipment that, they do so at their own risk and that, if any injury occurs to the person(s) using the equipment, Tahoe Event Rentals, it’s employees, officers, directors, shareholders, agents, successors and assigns shall not be held liable for any such injuries, and/or resulting damages and, further, shall indemnify Tahoe Event Rentals in the event they are held liable for any injuries and/or resulting damages. This contract contains the entire agreement between the parties and shall not be enlarged or modified except in writing and signed by all appropriate parties. WARNINGS: Rented items can be dangerous and may in some cases contain or emit harmful substances, shift, move, leak, catch fire, and overturn particularly in severe weather. Rental items should be used, maintained, and repaired with caution and by properly qualified, instructed and if applicable, licensed adults.

PICK UP POLICY

CLIENT is to come prepared to load and pack all items with proper materials to secure rentals (e.g. moving blankets, tie downs etc). CLIENT understands there is no guarantee of staff to load at the time of pick up. Tahoe Event Rentals is not liable for any damage to vehicles during loading and unloading.

DELIVERY

CLIENT must make sure the event site is prepared and ready for drop off or set up. CLIENT agrees to ensure that the site is reasonably clean, safe, secure and fit for delivery and use of the rented item(s) at all times. It is the client’s responsibility that all irrigation that can damage rentals is shut off. Any damage related to sprinklers or hose will be the client’s responsibility to pay for the damage. A representative or point of contact must be present at the time of delivery. Please provide a phone number for the point of contact prior to delivery date. All deliveries will be dropped off at the closest ground level entrance that is accessible by a trailer or large truck. Any deliveries requested to a specific location that involve hills, stairs, elevators, rough roads, and longer access routes may incur a service fee. Please have all items prepared for pick up at the same location as the drop off point. All rentals must be stowed or prepared for pick up the same way they were dropped off. If rental items are not returned to the same drop-off location by the time of pick up, CLIENT will be charged a 20% labor fee based on the rental invoice.

Set-up and breakdown services are available for an additional fee. Set-up and breakdown are included for some specifics rentals including dance floors. Specifically requested delivery or pick-up times outside of normal business hours are subject to an added fee.

TENTS

CLIENT is responsible for knowing and obtaining any/all permitting required by county and state officials.

STAKES OR WATER BARRELS – CLIENT is responsible for locating water or power lines below ground prior to staking. Call 811 to find out where your gas lines are located and go to www.ca811.org at least 3 full working days in advance. Tahoe Event Rentals is not responsible for any damage caused during the installation of the tent(s).

CLIENT shall not violate any applicable instruction, law, rule, regulation, policy of insurance or warranty regarding tenting. CLIENT shall not allow anyone to use open flames in, under, or near tenting. Additionally, CLIENT shall not allow any abuse, misuse, overuse, move, remove, conceal, repair, modify, or damage to tenting.

SEVERE WEATHER

Tents/canopies are temporary structures. Strong winds, snow loads, lightning and the like, may create situations that could threaten a tent’s viability. CLIENT should be aware of severe weather conditions and have a plan to evacuate a tent if such conditions manifest. If severe weather threatens a tent(s), it is the customer’s responsibility to evacuate the tent(s). Under no circumstances should open flame ever be introduced into any tent structure.

All wood rentals, including all dance floors, must be sheltered from any rain/snow/hail event. These rental items are not waterproof and will be damaged or destroyed if exposed to moisture such as rain/snow/hail. It is the client’s responsibility to ensure adequate coverage is available for these rentals. If rain/snow/hail event is predicted Tahoe Event Rentals reserves the right to cancel delivery if CLIENT cannot show they have adequate coverage for rentals. CLIENT will not receive any refund in this circumstance. CLIENT is fully responsible for any cost incurred to repair or replace damaged rentals due to rain, snow, hail or any other preventable weather factor which could have been avoided by having proper rental coverage.

If severe weather is predicted on the day of your event, Tahoe Event Rentals reserves the right to cancel rentals. For cancellations initiated by Tahoe Event Rentals due to a severe weather forecast, refunds will be issued.

CANCELLATION

All orders can be canceled with a 100% refund within 14 days of the original deposit date. All orders are non-refundable after 14 days of original deposit.

Changes to existing orders can be made free of charge up to 30 days prior to the scheduled event. If items are fully removed from an order, charges will still apply. CLIENT may adjust quantity of rental items however the invoice total cannot reduce lower than the initial deposit amount.

FORCE MAJEURE

Neither Party will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, government shutdown civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy.

DAMAGE WAIVER

We charge a 10% damage waiver for the total amount of the rentals. This waiver is meant to cover damage to rental items but will not exempt the party responsible from damages exceeding the waiver amount. If damage to rentals exceeds the 10% waiver, CLIENT will be responsible for the cost of repair or replacement of damaged property. The waiver fee is fully refundable if all rented items are returned in their original condition.
